The Moscow Mayor, City Council and Staff welcome you to tonight's meeting. We appreciate and encourage public participation. For regular agenda items, an opportunity for public comment is sometimes provided after the staff report. However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations will be placed on the time allowed for comments. Citizens wishing to comment on business which is not on the agenda will be provided the opportunity to do so as item number 3. If you plan to address the Council, you will find a list of "Tips for Addressing the Council" on the table outside the City Council Chambers. Thank you for your interest in City government.
RENEWING OUR FOCUS - At each meeting, one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message. Contact a Council-member with examples to share at future meetings.

C. Airport Grant - Robb Parish
The Pullman-Moscow Regional Airport has received a grant offer from the FAA to: buy a new snowplow; renovate snow removal equipment building to accommodate new snowplow; acquire ADA compliant passenger boarding ramp; install mid-field wind cone; and to fund engineering and design for an internal access road. Approval is required from both the City of Moscow and the City of Pullman to accept the grant. Reviewed by the Public Works/Finance Committee on July 9, 2007.
ACTION: Approve acceptance of FAA Grant for the Pullman-Moscow Airport.
D. Palouse Pride 2007 Alcohol Permit Request for East City Park - Dwight Curtis
In accordance with Moscow City Code 5-13-4(B), Palouse Pride has requested that the Council pass a Resolution allowing them to have a beer-wine garden for the Palouse Pride event to be catered by Sandpiper Grill in East City Park, on Saturday, July 28th from 12:00 p.m. to 4:00 p.m. There will be food vendors, live music and other activities at the event. The licensed vendor will sell alcohol to adults with proof of age in one designated, roped off area. Palouse Pride event organizers will provide their own security, which is supported by Moscow Police Chief, Dan Weaver. Reviewed by the Administrative Committee on July 9, 2007.
ACTION: Approve Resolution 2007-14.
E. Motorcycle Classic 2007 Alcohol Permit Request for Friendship Square - Dwight Curtis
In accordance with Moscow City Code 5-13-4(B), the Moscow Chamber of Commerce has requested that the Council pass a Resolution allowing them to have a beer-wine garden for the Moscow Motorcycle Classic event to be catered by The Plantation in Friendship Square for the Moscow Motorcycle Classic 2007, on Saturday, July 28th from 7 p.m. to 10 p.m. The licensed vendor will sell alcohol to adults with proof of age in one designated, roped off area. Event organizers will hire a minimum of 2 Moscow police officers to be on site throughout the beer-wine garden open operation time. The cost is $35 per hour per officer. This is recommended by Moscow Police Chief Dan Weaver. The event's sponsors have already received a permit to close Main Street from mid-block between 3rd Street to and including 5th Street for the event. The event includes a street dance and the beer-wine garden. Reviewed by the Administrative Committee on July 9, 2007.
ACTION: Approve Resolution 2007-15.
F. Use of Manley Refund for Memorial Bench - Patti McKinney/Gary J. Riedner
The City provides employees the opportunity to participate in a Flexible Spending Account pursuant to Internal Revenue Code Section 125(b). This plan is administered by Manley and a copy of a summary plan description is contained in the Committee packet. The use of the Flexible Spending Account is entirely voluntary by individual employees and allows employees to utilize limited "before-tax" dollars to pay the employee's share of certain medical and insurance related expenses, such as employees' share of dependent health insurance, medical and related expenses, disability and life insurance. The amount of the employee's contribution is at the employee's discretion, up to a maximum of $5,000 employee contribution per year. Any funds which are not utilized by the employee are forfeited (use it or lose it) according to the plan and the IRS code. The remaining funds are then refunded to the City. These funds are generally included in the Refunds and Reimbursements line item in the General Fund Revenue budget. In 2006, this refund amounted to $1,770.09. The Employee Advisory Committee (EAC) would like to utilize these funds for the purchase of a bench in Friendship Square as a memorial to Officer Lee Newbill, who was killed in the line of duty on May 19, 2007. A memo from EAC Chair Patti McKinney is attached. This expenditure was not included in the FY2007 budget, so Council authorization is necessary for approval. Reviewed by the Public Works/Finance Committee on July 9, 2007.
ACTION: Approve use of Manley refund for a Lee Newbill memorial park bench.
G. Request for Authorization to Act as Contracting Entity with Kendig Keast Collaborative for Potential Redevelopment Area - Gary J. Riedner
On July 2, 2007, the City Council approved the amount of $2,100 as City participation in planning efforts for the area generally between Moscow's downtown and the University of Idaho which is being considered as a potential redevelopment project area by the Moscow Urban Renewal Agency. All of the property owners in the area have agreed to fund the major part of a preliminary planning process to assist in identifying potential development of the property which will complement the area and serve to provide linkages between the downtown and University of Idaho. Kendig Keast Collaborative (KKC) has submitted a scope of work to provide those services with a focus on owner and community input. It is requested that the City of Moscow act as the contracting party with KKC on this planning effort. Reviewed by the Public Works/Finance Committee on July 9, 2007.
ACTION: Approve authorization of the City to enter into the contract.
2. Mayor's Appointments - Mayor Chaney
ACTION: Approve appointments or take such other action deemed appropriate.
3. Public Comment and Mayor's Response Period (limit 15 minutes) - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes. Mayor will respond to comments from previous meeting.
4. Public Hearing - Vacation of Right-of-Way and Easement in Christopher's Crossing Subdivision
Colin Johnson has previously received City Council approval to reconfigure Lots 1 and 2, Block B of Christopher's Crossing Subdivision in to three lots; a change that also included a modified location of both the Lande Lane cul-de-sac and the connecting sidewalk to Hirschi Road. The reconfiguration requires that a certain portion of the originally platted cul-de-sac right-of-way and an access and utility easement across Lot 2 be vacated.
ACTION: Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read and published by title only; or consider the Ordinance on first reading; or reject the Ordinance; or take such other action deemed appropriate.
5. 2007 Overlay Project Bid Award - Les MacDonald
Bid opening was July 11th for a street maintenance project consisting of asphalt pavement renovations of certain City streets and alleys as follows: 1. Harding: Lemhi to Joseph 2. Lemhi: Harding to Mt. View 3. Washington: First to 'A' 4. Alley west of Jackson: 3rd to 6th 5. Alley east of Main: 6th to 7th. A single bid was submitted from Poe Asphalt Paving, Inc. of Pullman in the amount of $202,133.75. $201,000 is budgeted in the street department for this project; the $1,133.75 difference is available from other departmental line items.
ACTION: Approve the award of a contract to Poe Asphalt Paving, Inc. or take such other action deemed appropriate.
6. Sidewalk Café Ordinance - Randy Fife
The attached draft Ordinance has been prepared in consideration of licensing businesses in the Central Business (CB) Zoning District to establish by ordinance the City's practice of allowing use of sidewalks adjacent to existing eating and/or drinking establishments for sidewalk cafés in the public rights-of-way, with certain limitations. Reviewed by the Administrative Committee on July 9, 2007.
ACTION: Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read and published by title only; or consider the Ordinance on first reading; or reject the Ordinance; or take such other action deemed appropriate.
