Parents of transgender child suing school district

The parents of a six-year-old transgender child are suing their local Colorado school district over the little girl's access to the restroom.

Kathryn and Jeremy Mathis filed a complaint with the Colorado Civil Rights Division after the Fountain-Fort Carson School District 8 recently decided their daughter Coy could no longer use the girl's bathroom at her elementary school.

District officials say Colorado law doesn't require public schools to permit transgender students to use restrooms of the gender with which they identify.

District officials say Coy should use the boys' restroom, the staff's restroom or the one in the school nurse's office.

The parents say the district is violating Colorado's anti-discrimination act.

"You see a little girl walk into the boy's bathroom. That is setting her up in an unsafe situation. Or you see her having to walk quite away from her classroom in order to get to the staff bathroom or nurse's restroom and you are singling her out when you do that. You're creating a stigma that doesn't need to be created," said Kathryn.

Coy has since been pulled from public school and is now being home schooled.
