A more likely scenario is if you are at a party and in one room of the party some folks are partaking in smoking of weed.  You may not even smell it or know it is happening.
If the police come due to a noise complaint or something is everyone at the party who did not know suspect?

  Some times it's obvious, but other times not.

  Here is a simple example.  While hiking on Moscow Mountain last Saturday early in the morning, more particularly passing through Big Thumb on the east slope of Paradise Point, I caught a whiff of what seemed to be marijuana.  There had been some fresh footprints -- less than a couple of hours old -- near there in one of the enclaves where there was still snow, but I didn't see or hear anyone.

  Is it a violation of the law at issue if myself and/or others continue to hike through Big Thumb?

  I have had similar experiences through the years in several places on Moscow Mountain, the upper Palouse River drainage, the Dennises, Baldy, Skyline, Giant White Pine, the Samson Trail, etc.  Do people face arrest by merely using these places merely because a whiff of marijuana is sometimes sensed even when no one else is visible?  

  What about when one is driving on A Street with the car windows open and a whiff is caught?  Is arrest possible for driving on A Street?

  If so, such a law seems unconstitutionally vague.
