Presentation of the Accounts Payable Report for month ending April 30, 2011.

ACTION:  Sign the Disbursements Report for the month of April 2011.

3.                  Moscow-Pullman Airport 2011 FAA Grant Offer - Robb Parish

FAA has again asked airport sponsors to approve airport improvement grants in advance of the actual grant offer. The reason for this is the continued uncertainty of the FAA reauthorization by congress. The projects will be paid using a combination of entitlement funds—$1,264,858 and discretionary funding $3,000,000—plus local match of $224,466 which will be generated from passenger facility charges. Because FAA is expecting to issue the grants by June 1, 2011, they are asking for advance

sponsor approval of the maximum possible grant amount.

ACTION:  Recommend Council acceptance of the grant awards from FAA up to $4,264,858.00 or take other such action as deemed appropriate.

1.                  Approval of April 25, 2011 Minutes – Keli Jones



2.                  Draft Ordinance to change requirement of notice from registered mail to certified or regular mail - Randy Fife
            Currently, the City Code contains some sections that require notice to be sent by registered mail. Registered mail is typically used to establish a "chain of custody" and to create a record of each "stop" that a letter takes on its way from its origin to its destination. Certified mail confirms that a letter traveled from its origin to its destination but the letter carrier does not document the stops or possessions in between. Certified mail is commonly used for business and tax transactions, legal notices, and other transactions that require some assurance that the letter sent was received at the address to which it was sent.

There is a presumption in the law (under most circumstances) that a letter sent by regular mail arrives at its destination.  Because of the additional expense and unnecessary requirements of registered mail, the Legal department recommends that the sections in the City Code requiring registered mail be changed to allow for personal service, or service by certified or regular mail.

ACTION:   Approve the Ordinance language and forward this to Council with a recommendation to pass the Ordinance under suspension of the rules requiring three (3) complete and separate readings and that it be read and published by title only; or direct staff to amend the proposed language; or reject the draft ordinance; or take other action as deemed appropriate.


3.                  Draft Initiative and Referendum Election Ordinance Changes - Randy Fife
Recent changes to the Idaho State Code consolidating elections has led to suggested changes in Title 1 chapter 5 of the Moscow City Code relative to initiative and referenda. Those changes are meant to conform the City ordinance to the State Code and to recognize that the Latah County Clerk will be the Chief Elections Officer of the City when she/he is acting in that capacity.

ACTION:  Recommend approval of the Ordinance or take such other action deemed appropriate.
