Your logic being . . .

People can't download (for resale) MP3's without drawing major attention 
to themselves from those that are hired to enforce copyright laws.

I'm guessing that each state has (or will have) its own investigative 
branch similar to the IRS Investigation Division whose sole purpose is to 
find and prosecute tax evaders.
