MOSCOW CITY COUNCIL

REGULAR MEETING

The Moscow Mayor, City Council and staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For certain
regular agenda items, an opportunity for public comment may be provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  If you plan to address the Council, you will find
a list of "Tips for Addressing the Council" on the table outside the

PLEDGE OF ALLEGIANCE 
 
1.      Approval of Minutes of August 15, 2005 - Stephanie Kalasz

 
2.      Public Hearing on FY2006 Fee Resolution - Don Palmer
Staff has prepared the proposed FY 2006 Fee Resolution.  According to
Idaho law, a public hearing must be held if individual fee increases
exceed 5% of the previous year.  The FY 2006 budget reviewed during a
budget workshop conducted on July 25 and 26 and adopted August 15, 2005
is based on the proposed Resolution.  Increases of 5% or greater
include:  utility fees; some new Community Development fees; some
engineering fees; some map fees; some new day care fees; some Farmers'
Market fees; HIRC rental rates; and several Parks and Recreation new and
increased program fees as detailed on the attached Resolution.
 
         ACTION:  Approve the Resolution; reject the Resolution; or take
such other action deemed appropriate.
 
3.      Public Hearing 2925 Joseph Rezone - Andrew Ackerman
The applicant is requesting to rezone an approximate 1 acre parcel of
land currently addressed as 2925 Joseph Street, and generally located on
the south side of Joseph Street opposite of the Fairview Drive and
Joseph Street intersection, from Agriculture Forestry (AF) to
Low-Density Residential (R-1).  The applicant has indicated that they
wish to rezone the property to allow the creation of one additional
single-family residential lot.  The Planning and Zoning Commission
conducted a public hearing on the request on July 27th and recommended
approval of the application subject to the applicant demonstrating that
they can receive City services.
 
ACTION:  Approve Ordinance under suspension of the rules requiring three
complete and separate readings and that it be read by title only; or
reject the Ordinance; or take such other action deemed appropriate.
Relevant Criteria and Standards will be necessary as well.
 
4.      Public Hearing Meadowbrook 2nd Addition Preliminary Plat -
Andrew Ackerman 
This preliminary plat request proposes 21 lots, 12 of which are newly
platted and the remaining 9 would consist of reconfigured lots and the
vacated ROW from the original MeadowBrook Addition plat. The preliminary
plat also proposes connecting West View Drive from the current eastern
terminus to the stub coming off of Sixth Street in Rolling Hills.
Approval of the ROW vacation is contingent upon approval of the
preliminary plat and vice versa.
 
ACTION:  Approve the application as presented; Reject the application as
presented; Approve the application subject to specific changes and/or
conditions; Return the application to the Planning and Zoning Commission
for further public hearing and recommendation.
 
5       Public Hearing Meadowbrook 2nd Addition Right-of-Way Vacation -
Les MacDonald
An application was made to the City for a right-of-way vacation on
property located at the north end of Meadow Street in Meadowbrook Second
Addition.  The proposed plat includes realignment of a previously
platted but currently undeveloped portion of West View Drive and
elimination of a previously platted but currently undeveloped portion of
Meadow Street.  The realignment of West View Drive is necessary to make
a better connection of the two existing developed portions of the street
located to the east and west of the proposed plat.  The portion of
Meadow Street with the new subdivision boundary would no longer be
needed.  All of this land is included within the boundaries of the
proposed plat.  In order to assure that the City will retain
right-of-way through this area, the vacation process should not occur
until the preliminary plat is reviewed and approved by the City Council.
The vacation request was presented to the Public Works/Finance Committee
on August 22, 2005.
 
ACTION:  Approve the Ordinance under suspension of the rules requiring
three complete and separate readings and that it be read by title only;
or reject the Ordinance; or take such other action deemed appropriate.
 
6.      Sustainable Transportation Conference - Gary J. Riedner
Michael Kyte, Director of the National Institute for Advanced
Transportation, has approached the City with a request for the City to
sponsor a Sustainable Transportation Conference to be conducted on
September 22nd and 23rd in Moscow.  Specifically, the City has been
requested to sponsor a session entitled Land Use and Sustainable
Development in the approximate amount of $2,500.  The exact amount of
the sponsorship request will be presented to the Council at the
September 6th meeting.  It is proposed that sponsorship would be funded
from the Council's Legislative Reserve.  Sponsorship of this session
would allow the City to send up to 60 participates free of charge.  This
proposal was presented to the Administrative and Public Works/Finance
Committees on August 22nd, which recommended approval of the request.
 
         ACTION:  Approve City sponsorship of the Sustainable
Transportation Conference or take such other action deemed appropriate.
