According to the article (or my scan of it this a.m.) Kwate cited actions=20
on the part of the sheriff's office that could very well be construed as=20
creating a hostile work environment for this particular employee--the=20
demotion/position change which lead to 6 or 9k loss in salary.. (I can't=20
recall exact numbers).

I'd say if they (Kwate and the officer in question) can provide=20
documentation (i.e. employee evals and such) that would lead the courts to=
=20
believe PRIOR to the employee's political announcement he was considered a=
=20
solid employee.. they may well have the sheriff's office under the=20
proverbial gun.

The passive/agressive tactic of 'making the employee miserable' is too=20
often used in an attempt to lose an employee when one can't list valid=20
reasons for an out and out termination. As courts are prone to do.. one=20
can assume they will be taking all facts into consideration when deciding=20
validity of the claim.

I wish both sides a fair review.
