The law was enforced.  This is why it wound up in the
supreme court.

It all started because a neighbor with a grudge faked
a distress call to police and told them that a man was
going crazy in an apartment. The police went to the
apartment, pushed open the door, and found the two
men.

The two men involved in this case were each fined $200
and spent a night in jail for a misdemeanor sex
charge.
